THE "BEST SEAT IN THE HOUSE" SWEEPSTAKES - Official Rules

PROMOTION DESCRIPTION: The Pioneer Best Seat in the House Sweepstakes (the "Sweepstakes") begins on or about 12:01 am Eastern Standard Time (EST) on May 03, 2008 and ends at 11:59 pm EST on January 31, 2009 (“Entry Period”). By participating in the Sweepstakes, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Elevation Management, LLC. (“Sponsor”), which shall be final and binding in all respects.

ELIGIBILITY: This Sweepstakes is open only to individuals who are (i) legal residents of the 50 United States (and the District of Columbia), located in the U.S. at the time of entry, and (ii) are age eighteen (18) or older at the time of entry. Sponsor, Administrator and their respective parents, subsidiaries, affiliates, distributors, retailers, sales representatives, advertising and promotion agencies and each of their respective officers, directors and employees (collectively, the “Promotion Entities”), as well as the immediate family members and/or those persons living in the same households of such employees, officers and directors are not eligible to enter or win this Sweepstakes. This Sweepstakes is void where prohibited by law rule or regulation.

HOW TO ENTER: While at any of the events listed below, visit any of the Pioneer sound.vision.soul “Best Seat In The House” displays and enter the Sweepstakes by obtaining an Official “Prize Code Game Piece” (“Game Piece”) from the entry kiosk. Entry kiosks will be located at the Pioneer sound.vision.soul “Best Seat In The House” displays at the following events and venues on the dates specified:

In order to obtain your Official Game Pieces from any one of five kiosks at the venue, you must complete the Sweepstakes registration by providing the requested information (as detailed below) and submitting your entry at the kiosk. You may also be asked to answer optional questions; however, optional questions need not be answered in order to enter the Sweepstakes and doing so will not improve your chance of winning. Click “Submit Entry” to submit your entry form for the Sweepstakes. All entries must be received by the end of the Entry Period.

ALTERNATIVE METHOD OF ENTRY (AMOE): There is an alternative method of entering the Sweepstakes and determining whether you have won. To get a game piece without visiting any of the venues listed above, please do the following: (1) prepare a 3.5” x 5.5” card with your Name, Address, Phone Number, and Email address; (2) write on the card “I have read and accept the Official Rules of the Sweepstakes”; (3) if you wish for a copy of the prize code on your Official Game Piece to be mailed to you, write on the card “I wish for a copy of the prize code on my Official Game Piece to be mailed to me”; and (4) mail the card as well as a self addressed stamped envelope (Vermont residents may omit return postage) to Pioneer Best Seat in the House Sweepstakes; 8300 Douglas Avenue, Suite 625; Dallas, TX 75225. An Official Game Piece will be printed on your behalf and compared with the winning prize codes for the Sweepstakes. If you are a winner, your Official Game Piece will be mailed to you so that you may claim your prize. In addition, AMOE entrants to the Sweepstakes are eligible to be randomly selected for the $150 rebates described further below. All other Official Rules relating to the Sweepstakes apply to AMOE entrants, including but not limited to the requirements and deadlines for redeeming prizes and/or rebates. Limit one (1) request per outer mailing envelope and seventeen (17) total throughout the Entry Period.

OTHER LIMITATIONS REGARDING ENTERING THE SWEEPSTAKES: Limit one (1) entry per person per venue during the Entry Period.

Entrants must submit their name, address, and valid email address at the kiosk. All required information must be completed to enter and to be eligible to win. Incomplete entries will be disqualified. Entrants must provide a valid email address to be eligible to enter. In the event of a dispute regarding the individual who actually submitted an entry, the entry will be deemed submitted by the authorized account holder of the email address supplied at the time of entry, as applicable based on the method of entry. The potential winner may be required to provide Sponsor with proof that he/she is the authorized account holder of the email address associated with the winning entry. If a dispute cannot be resolved to Sponsor's satisfaction, the entry will be deemed ineligible. The Promotion Entities shall not be responsible for incorrect or inaccurate entry information, whether caused by entrant or by any of the equipment or programming associated with or utilized in the Sweepstakes, or by any technical or human error which may occur in the processing of the entries in the Sweepstakes. Proof of entering information at a kiosk is not considered proof of delivery to or receipt by Sponsor of such entry. The Promotion Entities assume no responsibility or liability for any error, omission, interruption, deletion, theft or destruction, or unauthorized access to, or alteration of entries.

All entries become the property of Sponsor and none will be acknowledged or returned. False, fraudulent and/or deceptive entries or acts shall render entrants ineligible for the Sweepstakes.

NOTE: Entry at the kiosks must be made by the entrant only. Entries made by any other individual or any entity, will be declared void and entrants will be disqualified for the Sweepstakes. The use of any device to automate the entry process, including the AMOE, is prohibited.

HOW TO WIN: Upon receiving your Game Piece, go to any participating Pioneer Dealer Store and compare the prize code printed on your Game Piece with the prize codes posted at the Store. If your prize code matches any of the prize codes listed on the official prize posters you win that prize. Dealer lists are posted at the event and by visiting http://www.pioneerelectronics.com/DomeCodes.

PRIZES/ODDS: The total value of all prizes that could be awarded is $277,000.

• Two (2) Grand Prizes of $100,000. Odds of winning a Grand Prize are 1:5,940,688.
• Three (3) First Place Prizes of $25,000. Odds of winning a First Place Prize are 1:3,960,458.
• Four (4) Second Place Prizes of $500. Odds of winning a Second Place Prize are 1:2,970,344.

Three Hundred Forty (340) entrants shall receive a rebate valid for up to $150 (or the purchase price whichever is lower) towards a Pioneer Mobile Electronics product purchased from an Authorized Pioneer or Pioneer Premier Dealer between April 12, 2008 and December 30, 2008. Rebates will be randomly assigned during the promotion period.

No transfer or substitution of prizes will be allowed, except at the sole discretion of Sponsor. Prizes will be mailed only to an address in the U.S. Sponsor shall have no liability for any prize that is lost, intercepted or not received by the winner for any reason.

HOW TO REDEEM YOUR PRIZE: If you are a potential winner of a Grand Prize, First Place Prize or Second Place Prize, send an email with your name and phone number to claims@scapromo.com with a subject line of “Pioneer Best Seat In The House Claim”.

HOW TO REDEEM YOUR REBATE: In order to claim the rebate (up to $150 or your purchase price whichever is lower), you must complete the required eligibility verification on the back of your Game Piece as (detailed below) and mail your Game Piece along with your original store receipt to: Pioneer Best Seat In The House Rebate PO BOX 10939 Rochester, NY 14610.

(a) a completed rebate form and signature,

(b) a copy of the sales receipt for a Pioneer Mobile electronics purchase, and

(c) the original UPC code AND Serial Number or Model Number cut from the product box.

Sales receipt must show the name and full address of the Authorized Pioneer or Pioneer Premier Dealer, and it must be dated between April 12 and December 30, 2008

All rebate documents must be postmarked by no later than January 16, 2009 to be eligible for the rebate

Rebate offer is void where prohibited, taxed or restricted by law. Offer valid for purchases made from an authorized Pioneer or Pioneer Premier Dealer in the United States between April 12, 2008 and December 30, 2008. Valid signature and valid serial number or model number on rebate form required. Purchase must be for consumer use only and not for resale purposes. Rebate is restricted to two (2) rebates per person with a maximum of two (2) rebates per household. Purchases by companies and other entities are not eligible. Not available to employees of Pioneer or any Pioneer or Pioneer Premier dealers or distributors. Packaging slips, credit card authorization slips, credit card statement or shipping documents will not be accepted as proof of purchase. The original UPC code AND Serial Number or model number cut from the product box is required for redemption. Please allow 8 weeks for processing. No responsibility is assumed by Pioneer Electronics, (USA) Inc., its affiliates, promotion agencies, distributors and/or dealers, for rebate documents not received by specified time and at specified address, regardless of reason, or for lost, stolen, illegible, incomplete, misdirected or delayed mail. Pioneer will not process any rebate requests that do not meet the above requirements. This offer cannot be combined with any other rebates or any in-store rebates or discounts. This mail-in rebate offer is not valid at the following stores: Best Buy, Circuit City, Car Toys, Tweeter or Crutchfield. Please check with these stores for more information. Offer not valid outside of the United States. Fraudulent submissions may result in prosecution under federal and state law.

All winning Game Pieces and rebate requests must be postmarked by January 16, 2009 and received by January 30, 2009. Failure to comply with the aforementioned time period may result in forfeiture of the prize or rebate. If any potential winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines a prize for any reason prior to award, such potential winner will be disqualified. Please keep a copy of your original Game Piece and original store receipt for your records.

TAXES: All taxes (and the reporting consequences thereof) and any other fees or costs associated with the prizes are the sole responsibility of the winners.

LIMITATION OF LIABILITY/GENERAL RELEASE / FORCE MAJEURE: By participating in the Sweepstakes, each entrant agrees to release and hold harmless the Promotion Entities from and against any and all liability for any injuries, loss or damage of any kind, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of a prize. participation in the Sweepstakes or in any Sweepstakes related activity, The Promotion Entities make no warranty, representation or guarantee express or implied, in fact or in law, with respect to any prize and specifically disclaim all such warranties, including without limitation, the implied warranties of merchantability and fitness for a particular purpose. Prizes will only be awarded to a verified winner. The Promotion Entities assume no responsibility for any kiosk, computer system, phone line, hardware, software or program malfunctions or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature. Without limiting the generality of the foregoing, Sponsor is not responsible for incomplete, illegible, misdirected, misprinted, late, lost, damaged, stolen, or (if applicable) postage-due Game Pieces or prizes; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet Service Providers, web sites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, or difficulties, printing errors, clerical, typographical or other error in the offering or announcement of the prize or in any prize notification documents, or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information. If, for any reason, the Sweepstakes is not capable of running as planned, including, due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which, in the sole opinion of Sponsor, corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves the right in its sole discretion to cancel, terminate, modify, suspend or extend the Sweepstakes in whole or in part In the event Sponsor is prevented from awarding prizes or continuing with the Sweepstakes as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man-made epidemic of health of other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis (e.g. SARS), order of any court or jurisdiction, or other cause not reasonably within Sponsor's control (each a “Force Majeure” event or occurrence), then subject to any governmental approval which may be required, Sponsor shall have the right to modify, suspend, or terminate the Sweepstakes. If the Sweepstakes is terminated before the designated end date, Sponsor will (if possible) select the winners in a random drawing from all eligible, non-suspect entries received as of the date of the event giving rise to the termination. Inclusion in such drawing shall be each entrant’s sole and exclusive remedy under such circumstances. Only the type and quantity of prizes described in these Official Rules will be awarded. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE THE KIOSKS OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES, OR TO ANNOY, ABUSE, THREATEN OR HARASS ANY OTHER PERSON IN CONNECTION WITH THE SWEEPSTAKES, IS IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY THE APPLICABLE INDIVIDUAL AND SEEK DAMAGES AND OTHER REMEDIES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. If any provisions of these Official Rules are determined to be invalid or unenforceable, these Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or unenforceable provision were not contained herein.

PRIVACY: Entry information may be shared with Sponsor's promotional partners to the extent entrants agree at the time of entry and to the extent required for prize fulfillment purposes. Except as provided in these Official Rules or as agreed to at time of entry, any entry information collected from the Sweepstakes shall be used in accordance with Pioneer Privacy Policy, located at http://www.pioneerelectronics.com/DomeCodes.

GOVERNING LAW/JURISDICTION: ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR SPONSOR IN CONNECTION WITH THE SWEEPSTAKES SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE INTERNAL LAWS OF THE STATE OF TEXAS WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OF CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE’S LAWS.

ARBITRATION PROVISION: By participating in this Sweepstakes, each entrant agrees that: (i) Any claim, dispute, or controversy arising out of, relating to, or connected in any way with the Sweepstakes or the awarding or redemption of prizes or the determination of the scope or applicability of this agreement to arbitrate will be resolved exclusively by final private and binding arbitration conducted pursuant to the AAA’s Procedures for Consumer-Related Disputes in conjunction with the American Arbitration Association’s (“AAA”) Commercial Arbitration Rules (if and as applicable depending on the amount in controversy); (ii) The arbitration shall be held at the AAA regional office nearest the administrator (iii) The arbitrator’s decision shall be controlled by the terms and conditions of these Official Rules and any of the other agreements referenced herein that the applicable entrant may have entered into in connection with the Sweepstakes; (iv) There shall be no authority for any claims to be arbitrated on a class or representative basis; and (v) The arbitrator shall not have the power to award punitive damages against the entrant or Sponsor. In addition, if the entrant is able to demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, Sponsor will pay as much of the entrant filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive.

WINNERS’ LIST/OFFICIAL RULES: Any legally required list of winners may be obtained by sending an email with subject line: "Pioneer Best Seat In The House Sweepstakes Winner's List Request" to WinnerListRequests@scapromo.com. All such requests must be received within six (6) weeks after the end of the Promotion Period. These Official Rules will be posted on the Kiosks.
